Promoting extreme thinness will become a criminal offense punishable with jail in France under a government-backed law that was tabled today to combat anorexia nervosa.

The world’s first use of the law to tackle eating disorders is broadly aimed at the media and fashion world, but especially at the websites and blogs of the co-called pro-ana movement. While many are support groups, others promote starvation as a “life-style choice”, with girls and young women posting their wasting images as “thinspiration” for others.

Social networking sites such as Facebook and MySpace have recently come under pressure in Britain and other countries to ban their pro-ana entries.

Fines of up to €30,000 and a two-year prison sentence will be imposed on offenders who “provoke a person to seek excessive thinness by encouraging prolonged restriction of nourishment” to the point of risking of death or damage to health. The prison term is raised to three years with a €45,000 fine if the person dies.

Some experts and fashion leaders oppose the Bill, which is expected to be passed by Parliament within months. “You do not solve this kind of problem with the law but with understanding,” said Jean-Paul Gaultier, the designer. Didier Grumbach, head of the French Couture Federation, said that it was not up to the state to legislate on beauty and aesthetic criteria,

The law, modelled on the offence of abetting suicide, was tabled by Valérie Boyer, an MP from President Sarkozy’s Union for a Popular Movement. Roselyne Bachelot, the Health Minister, gave it the Government’s blessing at the unveiling of a code for the media, advertising and fashion industry on “promoting healthy body images” and fighting anorexia.

“The pro-ana movements which spread their messages of death on the web must be the target for special attention,” Mrs Bachelot said as she presented Mrs Boyer’s draft Bill along with the voluntary code.

Up to 40,000 people suffer from anorexia in France, the great majority of them girls and young women. The 48-year-old elder daughter of Jacques Chirac, the last President, has been incapacitated for two decades with the disease.

Mrs Bachelot said that the “waif-like, diaphanous, transparent bodies on the walls of our towns, in our magazines and on our computer screens are exerting their power of harmful fascination on our society.” Anorexia was one of the most lethal of mental disorders, killing 20 per cent of long-term sufferers, she said.

Mrs Boyer, who has two teenage daughters, said that the new offence was necessary because “it was not possible to deal with the pro-ana sites under the law against provoking suicide or promoting cults.” She added: “We do not know who is hiding behind these sites, but there is real mental manipulation.” Her law was also aimed at magazines, she said.

It would probably be left to judges to define “excessive thinness” but this might be defined as a body mass index, she said. BMI rules have been set by some model agencies and fashion houses since September 2006 when the Madrid fashion show imposed a minimum index of 18 for catwalk models. This translates as a minimum weight of 56 kilos (8.8 stone) for a height of 1.75 metres (5 feet 9 ins).

France last year banned a controversial Benetton advertisement featuring Isabelle Caro, a French model-actress who has written a book on her continuing battle with the disease.

The French voluntary code, which was drawn up by a panel headed by two eminent psychiatrists, commits the fashion, media and advertising world to raising acceptance of varied body shapes. “We undertake the promotion of diversity in the representation of the body, avoiding all stereotypes which could favour potentially dangerous canons of beauty,” said the signatories.

What’s the fascination with pictures of anorexic women? last december, i wondered aloud about that and put together a little survey. it was inspired by detecting that vastly more internet surfers google words like “anorexic nudes” than words that would indicate that anorexia is something that needs to be treated.

not surprisingly, that post in december, entitled anorexia and sex, drew quite a bit of readers – 2,884 by july 14. 106 readers took the survey. today i want to give you a quick preliminary report on the results.

in the survey, i asked people to comment on their thoughts on viewing pictures of thin or anorexic women, either in the nude or scantily clad. around two-thirds (66 people) were kind enough to give their time to say something about that.

many readers – around a third of the comments – didn’t like the pictures, ranging from judgmental (“they look really unappealing and repulsive”) to concerned (“i almost can’t stand to look at even anorexics in bathing suits because it upsets me quite a bit”).

the next most frequent type of comment (although only one sixth of them) went in the other direction and

talked about how sexually attractive these pictures were. this was even more pronounced in the statistical part of the survey, where 49% said that thin was “sexy” or “very sexy”

when you disregard those who were either disinterested or ambiguous about the connection between being thin and being sexually attractive, then the percentage of those who said that thin was sexy or very sexy goes up to 84%.

however, when asked about their ideal sexual partner, being thin is not nearly as interesting. 29% want him or her to be “thin” or “i want to see bones” (37% if you disregard those for whom body size is not important).

these two observations are interesting – there is quite a bit of a difference between what people think is sexy and who they actually want to be with.

anorexia is sexy … delicate and fragile. also i find it attractive when someone is willing to go to a lot of work and maintenance to maintain they way they look. being anorexic is hard, being a tubby lump shows that you don’t care at all about how you look, at least not enough to do anything about it.

i’m a gay woman, and i admit, i’m obsessed with being thin. the slim models in the first set of pictures are very sexy to me, extremely attractive body type. i can’t help that, it’s what i feel.

the attraction of anorexic nudes is a combination of sexual lust and vulnerability of the girl. it may be that a very thin girl or women attracts the paedophilic instinct, without the guilt associated with that of abusing a child.

i believe that nude bodies of both males and females are beautiful. they can also be sexy and even erotic. sometimes looking at normal people gets boring, i think this is why i and other people like looking at slender, and even anorexic nudes. we are always looking for the unusual.

This post was in response to an article here that raised the issue of porn and anorexia;

It is not that we (yes, I came based on a similar search) are looking for actual anorexics as displayed in the second image. Rather, this is a manifestation of the shifting baselines phenomenon. Human evolution has trained us males to seek out physically fit, youthful mates. That was, until the oncoming of communal, agricultural lifestyles, very straightforward. It meant someone who looks like a contemporary runner, cyclist, or swimmer. Once communal living began to assign non athletic roles to certain members, a variety of body types began to emerge in society and we were culturally programmed to believe various body types are attractive.

This all was well and good until the food processing explosion of the 60’s and 70’s led to the state of the Western world today where ‘hideously obese’ is now the norm and people like myself who used to be called slightly plump (I’m 5′9″ and 180lbs) are constantly being hailed as bastions of fitness.

I am a very liberal man but I think it is going way over board when we refuse to speak the truth about ourselves as a society lest it hurt our feelings. Instead of admitting we are fat, fatso, lardypants, we collectively convince ourselves that fat is normal and that athletic, fit people are ‘anorexic’.

Then people like you try to convince people like me that we are somehow abnormal or perverted (using clever euphemisms) for being attracted to women who look like they might have a chance of running fast enough to escape to and ascend a tree when a lion charges.

I’ll make a deal with you: instead of trying to convince me to beat my healthy, highly evolved preference for athletic women into submission in exchange for a chubby-chaser fetish, why don’t you just go on a diet and take up sport. Then we men will actually find you attractive without your needing to shame us into it.

In exchange, we men won’t try to convince you that our hairy backs, rump cellulite, or jiggly belt hangovers are normal and sexy and that you should be attracted to them — wait, we don’t try to convince you of that. We allow you to worship Brad Pitt in peace (and rightly so) — without resorting to calling him anorexic and you a pervert.

P.S. As for your suggestion on the other page that we are somehow bad for looking at pornography: consider that some of us men are deeply in love with the women in our lives and refuse to cheat on them yet are still, by DNA, members of a non-monogamous, hyper-sexual species.
